Homebuyers Ke Liye Important Lesson: MREAT Ne Diya Case Continue Karne Ka Ek Aur Chance
Kabhi-kabhi ek legal case mein ek hearing miss hona ya advocate se proper communication na hona homebuyer ke liye badi problem create kar sakta hai. Lekin ek recent MREAT order mein homebuyers ko apna case aage pursue karne ka ek aur mauka mila.
Yeh matter Vijendrasingh & Anr. vs. Macrotech Developers Ltd. se related hai.
Homebuyers ka appeal Maharashtra Real Estate Appellate Tribunal (MREAT) mein pending tha. Lekin November 22 aur December 6, 2024 ki hearings mein na homebuyers aur na hi unke advocate present hue. Iske baad 15 January 2025 ko appeal "want of prosecution" ke basis par dismiss kar diya gaya.
Homebuyers ke according, unke advocate ne unhe hearing dates aur case ki current status ke baare mein inform nahi kiya tha. Unhe dismissal ke baare mein 17 January 2025 ko pata chala.
Iske baad unhone doosre advocate se contact kiya aur case ko restore karne ke liye application file karne ki process shuru ki.
37 Din Ka Delay
Restoration application 22 April 2025 ko file hui. Ismein applicable 30-day limitation period ke baad 37 din ka delay hua.
Builder ki taraf se delay ko lekar objection raise kiya gaya aur kaha gaya ki actual delay 37 din se kaafi zyada hai.
Lekin MREAT ne applicants ki explanation ko consider kiya. Tribunal ko aisa koi material nahi mila jisse yeh lage ki homebuyers ne jaan-boojhkar delay kiya, case ko unnecessarily prolong karne ki koshish ki, ya kisi unfair advantage ke liye delay kiya.
Isliye 29 September 2026 ko MREAT ne 37 din ke delay ko condone kar diya.
Lekin Ek Important Baat
Is order ka matlab yeh nahi hai ki homebuyers ne builder ke against case jeet liya hai.
Tribunal ne filhaal delay ko maaf kiya hai. Ab restoration application par further decision hoga ki original appeal ko restore karke dobara suna jayega ya nahi.
Homebuyers Ko Is Case Se Kya Seekhna Chahiye?
Sabse important lesson hai:
Apne legal case ko sirf advocate ke bharose completely mat chhodiye.
Agar aapka matter MahaRERA, MREAT ya kisi court mein pending hai, toh:
Apna case number zaroor rakhein.
Hearing dates regularly check karein.
Apne advocate se case status ke baare mein update lete rahein.
Har important hearing ke baad proceedings ke baare mein poochhein.
Agar advocate se contact nahi ho raha hai, toh case ki status khud verify karne ki koshish karein.
Kisi limitation period ya deadline ko lightly na lein.
Legal matters mein time bahut important hota hai. Ek missed hearing ya delayed application future mein unnecessary complications create kar sakti hai.
Yeh case homebuyers ko ek important reminder deta hai — apne property dispute ya legal case ke baare mein informed rehna bhi aapki responsibility hai.
